الإمارات: قانون معيب بإمارة راس الخيمة يمنع قبول أي قضية ضد الحاكم سوى بعد موافقته ويحول النائب العام من ممثل للمجتمع إلى ممثل للحكومة
قالت الشبكة العربية لمعلومات حقوق الإنسان اليوم ، أنها حصلت على نص قانون معيب أصدره ولي عهد إمارة رأس الخيمة ونائب الحاكم ، وهو القانون رقم 2 لسنة 2010 ويحمل اسم “قانون دعاوي الحكومة” ، والذي جاء يحمل العديد من المواد المعيبة وعلى رأسها المادة 6 ( أ) والتي تقول” لا تقبل أي دعوى ضد الحاكم إلا بعد الحصول على موافقة سموه” ، وكذلك المادة (5) والبند (ج) من المادة (6) التي تجعل النائب العام ممثلا للحكومة والحاكم ، بدلا من تمثيله للمجتمع
وقد صدر القانون المعيب في 21مارس 2010 ، موقعا عليه من ولي عهد إمارة رأس الخيمة ونائب الحاكم الأمير “سعود بن صقر بن محمد القاسمي” في 9مواد ، مقوضا بدرجة كبيرة الحقوق الدستورية التي نص عليها دستور دولة الإمارات العربية المتحدة الصادر في 2ديسمبر 1971، والمعدل في 1996، حيث يكبل حق التقاضي ، ويحول النائب العام من ممثل للمجتمع إلى جهة تنفيذية تتبع الحكومة ، حيث يمثل الديوان الأميري براس الخيمة ، في القضايا التي قد تقبل ضد الحاكم من أي جهة او مواطن، أو التي يقيمها الحاكم ضد الخصوم سواء دعاوي مدنية او جنائية
وقالت الشبكة العربية لمعلومات حقوق الإنسان” ينبغي الطعن على هذا القانون بعدم الدستورية ، فحق التقاضي مكفول ولا يمكن أن يكون للخصم في أي قضية حتى لو كان الحاكم ميزة السماح بقبول رفع قضية ضده أو رفضها ، وهذه قاعدة دستورية في كافة البلدان التي تحترم سيادة القانون”

The Arabic Network for Human Rights Information said today that it obtained the text of a flawed act issued by the Crown Prince of Ras Al-Khaimah and the Deputy Governor. It is Act #2 /2010 and holds the name of “Government Case Act. It contains many defective articles naming article (6) ,”Any claim against the ruler is only accepted after obtaining the approval of His Highness,” and article (5) and item (c) of article (6) which makes the prosecutor general representing the government and the governor, rather than representing the community.

The act was passed on March 21st , 2010, signed by the Crown Prince of Ras Al-Khaimah and the Deputy Governor Prince ,Saud bin ***r bin Mohammed Al Qasimi, in 9 articles, significantly undermining the constitutional rights provided by the Constitution of the UAE of December 2nd , 1971, and amended in 1996. The new act , restricts the right to litigation and turns the prosecutor general from the representative of the community to an a government affiliate as the prosecutor general will represent the ruler body of Ras Al-Khaimah , in the cases that may be accepted against the ruler from any entity or citizen, or those case filed by the ruler against opponents, whether civil or criminal cases
The Arabic Network for Human Rights Information said “This act should be challenged for being unconstitutional . The right to litigation is guaranteed and can not be compromised in favor of any party if were the ruler giving them the authority to grant admission or rejection of a law suit against him. This is a constitutional norm in all countries that respect the rule of law.”
